TrialView Evidence Presentation System  TVX
One for the Record Books!

It has always been said that a picture is worth a thousand words.  But when it comes to legal proceedings, the litigation team at St. Louis, Missouri-based Korein Tillery might argue that perhaps the value is even greater.  And after handling America’s landmark class action litigation over "light" cigarettes resulting in a $10.1 billion settlement…they should know.

Korein Tillery, which also has offices in Chicago and Belleville, Illinois, is a nationally recognized law firm with a reputation for aggressively and successfully pursuing a wide variety of complex cases.

“The challenge in complex litigation is to peel away the layers of confusion to get to the heart of the matter,” said Mr. Stephen A. Swedlow, who spearheaded a team of attorneys and paralegals in the firm’s pursuit of tobacco manufacturers. “The advantage goes to the one who is able to do this in the most effective way.”

The presentation system enables evidence to be displayed quickly and with maximum impact on up to 15 electronic displays throughout the courtroom, including large LCD/plasma displays, or projection screens using video projectors. “One of the most effective attributes of the system was our ability to locate, create and present rebuttal video evidence for on-the-spot cross examination purposes,” said Swedlow in recounting the now famous 8-week trial of Price v. Philip Morris USA, which took place in Madison County, Illinois.

Noted Swedlow, “Desktop monitors were placed directly on the bench, on the witness stand and on each of the attorney’s tables along with a very large monitor that was situated to allow for viewing by the gallery.  The desktop monitors had touch screen and annotation capabilities which enabled the participants to easily focus attention on specific details. We were able to highlight and display documents and pictures, we ran computer animations and computer-generated presentations, and video deposition clips were edited and presented with enhanced audio.”

During the course of the trial, the TrialView was used to present thousands of exhibits and hours of video in what has been described as one of the most complex cases in Illinois history.

Did it make a difference?

“In the Price case, the trial court awarded $10.1 billion in damages, the largest award ever in Illinois and one of the largest in the country,” Swedlow said.  “And while it is impossible to determine how much of that is attributable to TrialView, what is clear is that its use definitely made a significant contribution,” he emphasized.
